The petitioner is languishing in custody since 26.8.2019 in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that from the house of the petitioner, 13.850 litres country made, Indian Made Foreign Liquor and beer were recovered.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house. Though the petitioner is accused in two other cases but he is on bail in those cases.

Learned APP submits that the recovery of illicit liquor has been made from the house of the petitioner.

Considering the quantity of recovery, the investigation

No.72610 of 2019(2) dt.04-12-2019 2/2 being concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court, Excise, Patna in connection with Gandhi Maidan P.S. Case No. 136 of 2019.

However, keeping in view the fact that the petitioner is accused in two other cases, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he gets involved in similar nature of case.
