The petitioner seeks regular bail in connection with Katihar Town P.S.Case no.581 of 2018 registered for offences punishable under Sections 457, 380, 411, of the Indian Penal Code and Section 25(1-b) A/26 of the Arms Act. Allegation as per FIR is that the petitioner was apprehended while committing theft in the house of the informant and other accused persons succeeded in fleeing away and from the possession of the petitioner two live cartridges along with the mobile of the informant were recovered. It further appears that the petitioner is accused in four other cases. Submission of the learned counsel for the petitioner is that no cash or other articles have been recovered and he has

Patna High Court Cr.Misc. No.71570 of 2018(2) dt.10-12-2018 2/2 been falsely implicated int his case. He is in custody since 21.8.2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Katihar Town P.S.Case No.581 of 2018. With the aforesaid observation, this application is allowed.
