JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 738C of 2012, disclosing offences under Section 498A of IPC and Section 3⁄4 of Dowry Prohibition Act.

Petitioner happens to be the husband of the complainant and there is allegation of demand of Rs.2,00,000/- and for that, assaulting her.

Submission of the learned counsel for the petitioner is that as a matter of fact, she is not ready to reside with the petitioner. It has further been submitted that there was a 'Panchayati' between the petitioner and complainant and in the ,Panchayati, complainant refused to reside with the petitioner,

Patna High Court CR. MISC. No.68979 of 2019(2) dt.04-11-2019 2/2 which will appear from Annexure-2 of this petition. Thereafter, petitioner has filed a divorce case, which has also been decided ex-parte in favour of the petitioner, which will appear from Annexure 3 of this petition.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Saharsa, in connection with Complaint Case No. 738C of 2012, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
