JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406, 420 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, this petitioner along with other accused persons fraudulently sold the land of informant to his wife on 16.11.2019.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further Petitioner and informant are cousin brother and there were two lands in the family one is situated at Sherghati, Gaya and another is Ramobariya at Buxar and it was mutually decided that informant will take the land at Sherghati

Patna High Court CR. MISC. No.1428 of 2023(2) dt.27-03-2023 2/2 and petitioner's family will take the land at Ramobariya and on the basis of mutual consent informant and his brother got gift deed from his mother and they also sold the land to different persons. It is purely a case of civil dispute and no criminal offence is made out.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (T) PS case No. 190/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
