The petitioner is languishing in custody for the offence punishable under Sections 304B and 201/34 of the Indian Penal Code.

The daughter of the informant died after five years of her marriage in her matrimonial house. There is allegation of commission of demand of dowry and torture for the same including physical assault.

Submission is that the allegation is of the year 2002. Chargesheet was submitted in the year 2002 itself, however cognizance was taken in the year 2017 and the petitioner had no knowledge of the case. Thereafter, he is in custody since 18.09.2019 Considering the entire facts, let the petitioner, above

No.75200 of 2019(4) dt.05-03-2020 2/2 named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No. 454/19, arising out of Balia (Parihara O.P.) P.S. Case No. 72 of 2002, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
