====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2018 The petitioner seeks regular bail in connection with Goh P.S. Case No. 37 of 2012 corresponding to G.R. No. 213 of 2012, registered for offences punishable under Sections 147, 148, 149, 341, 323, 434, 427 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act. Allegation as per F.I.R. is that some miscreants have assembled at the camp of M.D.L. Company armed with weapon and seized the generator and withdrawn the diesel and thereafter set eight vehicles on fire.

Submission of learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and except confessional statement there is absolutely nothing against him. Further there is no recovery and not put on T.I.P. It has also been

Misc. No. 5570 of 2017, vide order dated 08.03.2017 passed in Cr. Misc. No. 5121 of 2017, vide order dated 28.11.2016 passed in Cr. Misc. No. 39528 of 2016 and vide order dated 20.09.2018 passed in Cr. Misc. No. 47139 of 2018 and the petitioner is in judicial custody since 26.09.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar (DistrictAurangabad), in connection with Goh P.S. Case No. 37 of 2012 corresponding to G.R. No. 213 of 2012.
