The petitioner seeks regular bail in connection with Maker P.S. Case No. 64 of 2019 for the offence registered under Sections 25 (1-b)/a and 26 of the Arms Act.

The allegation is regarding recovery of one country made pistol from the petitioner.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is submitted that though the petitioner is accused in one other case but he is on bail in the said case. Lastly, it is submitted that the petitioner has already been suitably punished inasmuch as he is languishing in custody since 15.04.2019.

No.69738 of 2019(2) dt.10-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the period of incarceration, I deem it fit and proper to direct the petitioner herein to be released on bail.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Saran, Chapra in connection with Maker P.S. Case No. 64 of 2019.
