====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2018 Heard learned counsel for the petitioner, counsel for the informant and the State.

The petitioner seeks bail in Ballia P.S. Case No. 54 of 2018 instituted for the offence under Sections 341, 324, 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that petitioner caused firearm injury in the thigh of the informant. The injury report issued from the Primary Health Center, Ballia, has been enclosed as Annexure-2 wherein it is mentioned that one firearm injury has been found in the right thigh which was simple in nature.

Counsel for the informant has appeared and opposed

Patna High Court Cr.Misc. No.67784 of 2018(2) dt.27-11-2018 2/2 the prayer for bail. He has submitted that injury report has also been issued by private Doctor of Kalpana Nursing Home wherein the Doctor has opined the injury to be grievous in nature.

Petitioner is said to be in custody since 10.7.2018. Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 54 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
