JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-02-2023 Petitioner has renewed his prayer for regular bail in connection with Barauli P.S. Case No. 27 of 2020 registered for the offence under Section 302 of the I.P.C. inasmuch as earlier bail application of the petitioner was rejected on 03.12.2020 & 09.03.2022 vide Cr. Misc. Nos. 24384 of 2020 & 2508 of 2022 respectively. While rejecting the prayer for bail on the second occasion the petitioner was granted liberty to renew his prayer for bail after three months if the trial does not show any progress.
This court vide its order dated 01.02.2023 has called for a report from the court below regarding the present stage of the trial, which has been furnished by the learned District & Sessions Judge, Gopalganj vide letter no. 55 dated 4th February, 2023 and from perusal of the same it transpires that
Patna High Court CR. MISC. No.6575 of 2023(3) dt.22-02-2023 2/2 out of eight (08) charge sheet witnesses, seven (07) witnesses have already been examined and cross-examined and one witness is yet to be examined. The estimated time for conclusion of the trial has been mentioned in the report as four months. In view of the aforesaid position and the fact that trial is at the verge of conclusion, I am not inclined to grant regular bail to the petitioner at this stage.
The prayer for bail is rejected.
However, the petitioner may renew his prayer for bail after four months if the trial does not conclude. (Anil Kumar Sinha, J) praful/- U T
