The petitioner apprehends his arrest in connection with Jokihat (Mahalgaon) P.S. Case No. 101 of 2019 registered for the offences punishable under Sections 420/120(B)/414 of the Indian Penal Code.
Prosecution case disclosed that while petitioner was going to school, co-accused Indal Mandal stopped him and he introduced with co-accused Aftab and disclosed him that one of the relative of the Aftab is under treatment in Mumbai and he needs some money and one statue of gold weighing 30-31 Tola he wants to sell that statue in order to collect money and got pressure to purchase the said statue. Patna High Court CR. MISC. No.69618 of 2019(2) dt.19-11-2019 2/3 refused to purchase the said statue then they mounting pressure upon him to purchase the same. It is also said that they gave a piece of gold to verify the correctness of the gold by goldsmith. After verification, he was ready to purchase the same and came with the money Ishrwa Ghat along with Indal and Aftab. He refused to purchase the same but on the point of knife they snatched money from him and gave fake gold statue. Further case is that when he inquired about the Aftab he was found missing and later on he came and abused him and threatened him.
Learned counsel for the petitioner submits that nothing specific has been attributed against him. His name transpired on the disclosure of co-accused Aftab. Learned counsel for the petitioner further submits that there is no specific allegation against the petitioner. He further submits that another co-accused Nasim has been granted bail by a Coordinate Bench of this Court vide order dated 30.08.2019 passed in Cr. Misc. No.54606 of 2019.

Case No. 101 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bairlors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned and he has to appear before the Investigating Officer and will co-operate in the investigation otherwise prosecution shall be at liberty to move for cancellation of his bail bonds.
