====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B), and 34 of the Indian Penal Code.
3. As per the prosecution case, on 10.10.2023, the named accused persons came on two motorcycles and took away the son of the informant for a feast. Thereafter, the dead body of the informant's son was found floating in the water, which was taken out and identified as that of Amit Kumar.
4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. His name transpired during the course of investigation on the basis of the confessional statement of co-accused Kishori Kumar Yadav, who alleged that

It is further submitted that there is no allegation that he participated in the killing of the informant's son. The petitioner is in custody since 05.06.2025, and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of District and Additional Sessions Judge-III, Jhanjharpur, in connection with Phulparas P.S.
