2. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 447, 279, 337, 341, 323, 354(A), 504 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.
3. As per prosecution case, some unknown miscreants came on a motorcycle dashed informant's motorcycle and outrage the modesty to her.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to old dispute. He has committed no offence. Petitioner is not named in the FIR. He submitted that it was just a bike accident. During course of investigation, police found that girl was walking on

No.78793 of 2023(2) dt.07-12-2023 2/2 the middle of the road, informant's bag slip bogged down in handle of bike and due to which she fall down on the ground, after that she stand and slapped the bike rider and this incident was also supported by local shopkeeper. There is no specific overt act against the petitioner. He is languishing in judicial custody since 06.09.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO, Lakhisarai in connection with Lakhisarai P.S. Case No. 679 of 2023.
