====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Motihari Town P.S. Case No. 262 of 2018 instituted for the offence under Sections 420, 406, 379, 120(B)/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. Counsel for the petitioner further submits that petitioner has been remanded in the instant case from Motihari P.S. Case No. 381 of 2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.71491 of 2018(2) dt.10-12-2018 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Town P.S. Case No. 262 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
