2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 303 (2) and 317 (2) of the BNS, 2023.

3. The case of the prosecution, in short, is that the bike was stolen by unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the alleged occurrence took place on 04.08.2025 whereas the FIR was lodged on 05.08.2025. It is further submitted that prior to the present case, a complaint case had been filed by the niece of the petitioner in which the petitioner is a witness and the informant herein is an accused. The said case relates to

Patna High Court CR. MISC. No.76380 of 2025(2) dt.19-11-2025 2/2 matrimonial dispute. On the date of occurrence, the informant allegedly asked the petitioner to take away the bike that was parked in the premise of civil Court and when the petitioner did so, the present case instituted the very next day on the basis of C.C. Tv. Footage. It is further contended that the present case is an outcome of the matrimonial dispute involving Sushila Devi and that the petitioner has been framed only because he is a witness in that case. Moreover, the petitioner is languishing in judicial custody since 06.08.2025.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Banka P.S. Case No. 336 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka.
