The petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 727 of 2018, registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act. The allegation is regarding the police having got secret information that the accused persons were making plan for committing dacoity, whereafter the police had apprehended the accused persons including the petitioner herein and as far as, the petitioner is concerned, a mobile was recovered.

The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in

Patna High Court Cr.Misc. No.72470 of 2018(2) dt.13-12-2018 2/2 the present case. It is further submitted that the mobile seized from the petitioner belongs to the petitioner and is not stolen one. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 25.09.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Patna City, Patna in connection with Agamkuan P.S. Case No. 727 of 2018. (Mohit Kumar Shah, J) ajay gupta/- U T
