2. The petitioner seeks bail in connection with Biraul P.S. Case No. 370 of 2023 registered for the offence under Section 363, 366A of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have kidnapped the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. He further submits that victim was in a relationship with the petitioner.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 2.8.2023.

6. Learned APP for the State vehemently opposed

Patna High Court CR. MISC. No.77967 of 2023(3) dt.29-02-2024 2/2 the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Biraul in connection with Biraul P.S.
