The petitioners seek regular bail in connection with Excise Case No.1591 of 2018 (arising out of Barhara P.S.Case No.394 of 2018) registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 of the Indian Penal Code.
Allegation against the petitioner is about recovery of 38 ltrs. of liquor from the Bolero vehicle and the petitioner no.1 is the Driver and the petitioner no.2 is the Khalasi. Submission of the learned counsel for the petitioner is that they have nothing to do with the seized articles and though the petitioner no.1 is accused in one more case but it does not
Patna High Court Cr.Misc. No.73884 of 2018(2) dt.14-12-2018 2/2 relate to similar type of case. He is in custody since 4.10.2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th A.D.J., Bhojpur at Ara in connection with Excise Case No.1591 of 2018 (arising out of Barhara P.S.Case No.394 of 2018).
With the aforesaid observation, this application is allowed.
