JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Pakribrawan (Dhamoul) P.S. Case No. 185 of 2019, registered for the offences punishable under Sections 147, 148, 149, 307, 387, 325, 341, 379, 354 (B) of the Indian Penal Code.
As per F.I.R female members of the informant was going to call attend the nature call then petitioners and other accused persons dragged one of the female members in order to outrage her modesty. Allegation against petitioner No. 1 and other accused persons is that they assaulted the informant sides causing injuries. Submission of the learned counsel for the petitioner is that there was enmity between the parties and nobody sustained serious injury and opinion regarding injury are kept reserve.
Learned A.P.P. has opposed the prayer for bail on the ground of nature of allegation.
Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record.
