The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302, 120(B), 341, 342, 201, 323, 504, 506/34 of the Indian Penal Code.

Prosecution case in nutshell is that informant's sister was married to co-accused Ram Kumar Mahto and she was blessed with 3 children out of her wedlock. Co-accused Ram Kumar Mahto used to assault her sister and finally murdered her and solemnized second marriage with the petitioner. The allegation against the petitioner and other co-

Patna High Court CR. MISC. No.78588 of 2023(3) dt.02-02-2024 2/3 accused persons is that they murdered the daughter of informant's sister, namely, Kajal Kumari and disposed off the body in order to conceal the evidence.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. Informant has given a petition before the trial court, supported by an affidavit contended that deceased, Kiran Kumari died due to natural death but due to wrong information, the present case has been instituted. Deceased was suffering from chronic disease and the husband of the petitioner had admitted her to hospital. Moreover, the petitioner is languishing in judicial custody since 06.09.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the

The above named petitioner is directed to be enlarged on bail in connection with Mansurchak P.S. Case No. 85 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st, Begusarai.
