Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Banka P.S. Case No. 294 of 2022 registered for the offence under Section 366(A) of the Indian Penal Code and Section 4/8 of the POCSO Act, 2012.
The allegation against the petitioner and other accused in short is that the victim girl disappeared and for that the informant suspected the petitioner and his family members. It has been argued by the learned counsel for the petitioner that the petitioner is innocent and the girl had an affair with the petitioner and they had eloped and thereafter, they got married at Devghar in Baba Baidyanath Dham Temple. He also submits that in the medical examination, the age of the girl has been found between 17-19 years.
Patna High Court CR. MISC. No.2515 of 2023(2) dt.25-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the aforesaid facts that the petitioner is in custody since 02.06.2022, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI, Banka in connection with Banka P.S.
