JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 04-02-2020 The petitioner is the widow of late Dev Kumar Das @ Dev Kumar, an employee of the respondents. The late husband of the petitioner was appointed as Clerk in Project Girls High School, Bishwadighi, Balrampur, Katihar.

2. The claim of the petitioner is that during the service tenure of her late husband, he was not granted the benefits of ACP even though he was entitled for the same. The further grievance of the petitioner is that even the annual increments to which the late husband of the petitioner was entitled was never paid to him during his life time.

The petitioner, under the aforesaid circumstances, is directed to make a detailed representation before the Director, Secondary Education, Govt. of Bihar, Patna (respondent No. 2) within a period of two weeks from today, who, on receipt of the same, after seeking necessary information from the District Education Officer, Katihar and verifying the claim of the petitioner, shall pass a reasoned order in accordance with law within a further period of eight weeks thereafter.

4. If the claim of the petitioner is found to be tenable, necessary sequel order shall also be passed ensuring the payment of increments and the benefits of ACP to the late husband of the petitioner.

5. With the aforesaid observation/direction, the writ petition stands disposed off.
