Petitioner seeks bail in Patory P.S. Case No.13 of 2018 registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.

Informant is the uncle of the deceased who has stated in his written complaint that marriage of his niece was solemnized in the year 2015 with elder brother of the petitioner and from the said wedlock, a daughter was also born and, thereafter, due to non-fulfillment of demand of motorcycle, she was tortured and also killed.

Petitioner is brother-in-law of the deceased and allegation against him is of general and omnibus in nature. Considering the aforesaid facts and circumstances of

No.68805 of 2018(2) dt.03-12-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 4th, Samastipur in connection with Patory P.S. Case No.13 of 2018, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
