Petitioner apprehends his arrest in Badem O.P. Nabinagar P.S. Case No.297 of 2018, registered under Sections 379, 411, 420 of the Indian Penal Code, under Sections 47/40 of the BMMC Rules as well as under Section 15 of the Environmental Protection Act.

The informant alleged that the tractor of the petitioner with loaded sand was recovered. The driver of the tractor fled away.

Learned counsel for the petitioner submits that the driver of the tractor was plying the tractor on hire and petitioner has falsely been implicated in this case.

Considering the facts and nature of allegation made against the petitioner, let petitioner, above named, in the event

Patna High Court Cr.Misc. No.73972 of 2018(2) dt.19-12-2018 2/2 of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Badem O.P. Nabinagar P.S. Case No.297 of 2018, subject to the conditions laid down under Section 438(2) Cr. P.C.
