JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No. 400 of 2013, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is of committing loot from the tractor driver.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name has surfaced on the basis of confession of co-accused and except that there is nothing against the petitioner. Further submission is that nothing has been recovered from the petitioner and he is not put on T.I.P and he has been in judicial custody since 27.09.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court Cr.Misc. No.73527 of 2018(2) dt.14-12-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 400 of 2013, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
