The petitioners apprehend their arrest in Ara Nawada P.S. Case No. 816 of 2018 dated 29.11.2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 354, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned Chief Judicial Magistrate, Bhojpur, Ara.

After some arguments, learned counsel for the petitioners seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn. However, if the petitioners surrender before the

Patna High Court CR. MISC. No.877 of 2023(2) dt.02-05-2023 2/2 learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that in the F.I.R. no time and date is mentioned and petitioners have no criminal antecedent and the guardian of the victim has not filed the present case, the present case is filed by the maternal-brother.
