The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 354B, 302, 306, 201, 34 of the Indian Penal Code. As per prosecution case, informant alleged that when he was on patrolling he heard an alarm of a woman that a thief has entered her house, informant reached there and apprehended the boy and taken him into custody, he disclosed that he has love affair with the daughter of this petitioner. It is further alleged that petitioner has killed her daughter with the help of co-villagers.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence.

Patna High Court CR. MISC. No.5322 of 2023(2) dt.12-04-2023 2/2 Petitioner is mother of the deceased and she has falsely been implicated in this case merely on the basis of suspicion. There is no eye witness of the alleged occurrence and there is no specific overt-act of allegation leveled against the petitioner. It is further submitted that the deceased committed suicide after jumping from the roof. Petitioner has got no criminal antecedent moreover, she is languishing in judicial custody since 31.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Fatehpur P.S. Case No. 454 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-X, Gaya.
