JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. At the very outset, it is informed that petitioner no. 1 has already been arrested and accordingly, his prayer for anticipatory bail stands dismissed being infructuous. Petitioner no. 2 apprehends his arrest in connection with Tandwa P.S. Case No. 75 of 2018 registered for the offences punishable under Section 30(a) of Bihar Excise Prohibition and Excise Act, 2016.
The written report of informant goes to show that the name of petitioner no. 2 was disclosed by the villagers but in the written report, the informant has, nowhere, disclosed who had named the petitioner no. 2.

No.73465 of 2018(2) dt.20-12-2018 2/2 Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner no. 2 does not have any criminal antecedent, it is ordered that petitioner no. 2, namely, Lallu Paswan, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII cum Special Judge (Excise), Aurangabad in Tandwa P.S. Case No. 75 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
