====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 05.01.2022 and is father of Shamsher Alam. Learned counsel further submits that allegation against the petitioner is of kidnapping the minor daughter of the informant. It is next submitted that the victim in her statement under Section 164 Cr.P.C. did not support the case of the prosecution and, accordingly, Shamsher Alam was granted regular bail by order dated 07.04.2022 in Cr. Misc. No. 7204 of 2022 by a Coordinate Bench of this Court.

Patna High Court CR. MISC. No.858 of 2023(2) dt.29-04-2023 2/2 Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with POCSO Trial No. 45 of 2022 arising out of Nanpur P.S.
