JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner, who claims to be 82 years of age and is in custody since 13.05.2019, seeks bail in connection with Kharagpur P.S. Case No. 160 of 2019 which has been instituted for the offences under Sections 341, 323, 324, 307, 302, 504, 34 of the Indian Penal Code.

Because of the cattle of the informant having strayed in the premises of the petitioner and others, the petitioner along with three others went to the house of the informant and assaulted her husband. As a result of the aforesaid assault, the husband of the informant died after a short treatment.

Learned counsel for the petitioner has submitted that though the petitioner has been named in

Patna High Court CR. MISC. No.71616 of 2019(2) dt.04-12-2019 2/2 the F.I.R but the accusation is not specific. Apart from this, it has been submitted that the old age of the petitioner entitles him to be considered for grant of bail. The deceased appears to have received only one injury. The petitioner and the informant are agnates, which fact stands admitted in the F.I.R.

With respect to the age of the petitioner, learned counsel has relied upon the age as depicted in the Aadhar Card of the petitioner.

Considering the aforestated facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IVth, Munger in connection with Kharagpur P.S. Case No. 160 of 2019.
