The petitioner seeks regular bail in connection with Belhar P.S. Case No. 202 of 2018 for the offences punishable under Sections 30(a)(g), 32(2) & 37(b) of the Bihar Prohibition and Excise Act, 216.

The allegation is regarding recovery of 8.5 liters of Mahua liquor from the motorcycle of the petitioner after the petitioner was apprehended with that motorcycle. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 22.07.2018.

Patna High Court Cr.Misc. No.74957 of 2018(2) dt.14-12-2018 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd, Banka in connection with Belhar P.S. Case No. 202 of 2018.
