2. The petitioner seeks regular bail in connection with Maigra P.S. Case No. 26 of 2022 registered for the offence under Sections 363, 366(A)/34 of the Indian Penal Code and later on under Sections 302, 376, 120B of the Indian Penal Code and Section 4/6 of the POCSO Act.
3. As per the prosecution case, the petitioner is accused of abducting a minor victim girl, committing rape with her before the murder of the victim.
4. Materials have come during investigation in support of the allegations levelled against the petitioner. The
Patna High Court CR. MISC. No.81281 of 2024(3) dt.09-04-2025 2/2 petitioner is in jail since 19.06.2022. In the trial, six witnesses have already been examined who have supported the prosecution case.
5. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, this application for regular bail is dismissed.
6. The trial must be concluded at the earliest since it arises out of a rape and murder of a minor girl.
7. Let a copy of this order be communicated to the Principal District and Sessions Judge, Gaya through FAX for its compliance forthwith.
