The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is recovery of 135 litres of foreign liquor. He submits that there is no recovery from the conscious possession of the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 08.09.2019. He further submits that the petitioner has agreed to deposit Rs. 15,000/- in the Patna High Court, Legal Services Committee.

No.69066 of 2019(2) dt.25-11-2019 2/2 In the facts and circumstances of the case, let the petitioner, above named, be released on bail subject to deposit Rs. 15,000/- in the Patna High Court, Legal Services Committee, Patna on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judgecum-Special Judge, Excise, Motihari, East Champaran in connection with Excise Case No. 838 of 2019.
