1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 109(1), 351(2), 352, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his son had put fishing net for fishing, when accused persons including the petitioner came and demanded fish, on objection by his son, the accused persons fired 3-4 round but his son managed to save himself, next alleges that the accused persons can again attack on account of existing dispute.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.76622 of 2025(2) dt.27-11-2025 2/2 petitioner has been falsely implicated in the instant case by the informant with general and omnibus allegation of firing. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant himself alleges that there is an existing dispute between the parties as such the instant false case came to be instituted with general and omnibus allegation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pawana P.S. Case No.54/2025, subject to the conditions as laid down under Section 482(2) B.N.S.S.
