2. The petitioner apprehends his arrest in connection with Udwantnagar (Gajrajganj) P.S. Case No. 143/ 2024 dated 10.04.2024 registered for the offence(s) punishable under Section(s) 323, 341, 354B, 379, 504 and 506 read with section 34 of the IPC.

3. The main submissions advanced by petitioner's counsel are that there is simple allegation against the petitioner and as per the FIR, the petitioner first entered into house of the informant thereafter abused her and pushed her down on the ground and except this there is no other allegation against the

In fact, there is a civil dispute in between the petitioner and informant's father-in-law, Parmeshwar Sharma, as one Rameshwar Sharma purchased the land in question from the cousin father-in-law of the informant and from the said Rameshwar Sharma the petitioner purchased the said land in the year 2020 and thereafter a Title Suit No. 222 of 2022 was filed by the informant's father-in-law against the seller, Rameshwar Sharma and the petitioner and the same is still pending and to create pressure upon the petitioner a false story has been manufactured in respect of the alleged occurrence. It is further submitted that though against the petitioner there are criminal antecedents of three cases but he has got bail in all the said cases.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering aforesaid submissions advanced by the petitioner's counsel and mainly taking into account the nature of allegation appearing against the petitioner from the FIR, coupled with the aforesaid civil dispute running in between the parties, this court is inclined to grant the relief of anticipatory bail to the petitioner. Case No. 143/ 2024 on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
