JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a)/41/32 of the Bihar Prohibition and Excise(Amendment) Act-2018.

Sixty litres of foreign liquor has been recovered from the car of the petitioner.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. He has clean antecedent. Learned counsel for the State submits that the huge amount of liquor was recovered from the vehicle. It is further alleged that petitioner is the registered owner of the said vehicle. Considering the facts of the case as also the fact that
