Petitioner seeks bail in Musrigharari P.S. Case No. 152 of 2018 instituted for the offence under Section(s)272, 273 Indian Penal Code and Sections 30(a), 47 of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during course of duty, police party reached at Gangapur Cold Storage and saw a Pick-up Van. Seeing the police party some persons started running away. On chase, petitioner along with other persons were arrested by the police whereas two persons managed to escape. Total 2616 bottles, containing 981 litres of foreign liquor were recovered from aforesaid pick-up van. Petitioner is driver of aforesaid pick-up van.

No.73186 of 2018(2) dt.07-12-2018 2/2 Considering the fact that huge quantity of illicit liquor has been recovered from the pick-up van and petitioner was driver of aforesaid pick-up van, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial and make all efforts to conclude the same as soon as possible preferably within a period of six months from the date of receipt of this order.

Petitioner is given liberty to renew the prayer for bail after six months in the event no substantive progress is made within aforesaid period.
