JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 376/341 and other ancillary sections of the Indian Penal Code and sections 4/6 of the POCSO Act.
As per the prosecution case, petitioner came to the house of the informant and committed rape on the minor grand daughter of the informant, who was alone in the house. Learned counsel appearing for the petitioner submits that the petitioner is innocent and had falsely been implicated in this case and as a matter of fact at the relevant time he was at Delhi to meet his sister. Moreover, victim and her grand parents were willing to marry the victim with the petitioner for which

Learned counsel for the State opposes the prayer for bail. He submits that the girl, in her section 164 Cr.P.C. statement, has supported the prosecution case. Considering the nature and gravity of allegation and statement of the victim, prayer for bail of the petitioner is rejected.
