The petitioner seeks relief for quashing the order dated 14.03.2019 (Annexure-8) passed by the Member, Lokayukta in Complaint No.-1/ Public (Health) 05/ 2018 by which direction was issued to the Civil Surgeon- cum- CMO, Rohtas at Sasaram to take action and terminate the petitioner from service, lodge FIR and also to take appropriate steps for recovery of salary.

The learned counsel for the petitioner submits that the learned Member, Lokayukta did not hear the petitioner before making such recommendations, that is, termination of service, institution of the FIR and recovery of salary and FIR has already been instituted but it appears from Annexure-8 that after enquiry finding the allegation true against the petitioner direction was given to the authority for taking necessary action in accordance

Patna High Court CWJC No.22130 of 2019(3) dt.16-12-2019 2/2 with law. Thus, I do not find any illegality in the impugned order.

The petitioner, if so advised, may file appropriate writ petition if he is aggrieved by any action taken by the Civil Surgeon in pursuance of the request made by the Lokayukta. Having considered the facts aforesaid, I find no merit in this writ petition and the same is, accordingly, dismissed. (Prabhat Kumar Jha, J) BKS/- U
