The petitioner seeks bail in Sursand P.S. Case No. 187 of 2018 instituted for the offence under Sections 392 and 411 of the Indian Penal Code.
Counsel for the petitioner submits that First Information Report is against unknown. The name of petitioner has come during investigation on the basis of confessional statement of co-accused Gunjan Kumar Mishra before the police. No Test Identification Parade has been held. There is no recovery of any incriminating article from possession of the petitioner. Counsel for the petitioner further submits that co-accused Sunil Kumar has already been granted bail by coordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.69928 of 2018(2) dt.03-12-2018 2/2 2.11.2018 passed in Cr. Misc. 66426 of 2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kuamr, learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Sursand P.S.
