2. The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 120 of 2023 for offences under Sections 302, 34 of the Indian Penal Code.
3. The allegation against the petitioner is that the petitioner and his father of committing murder of the sister in law of the petitioner who happens to be the sister of the informant. The learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence and the petitioner happens to be the brother in law of the deceased and there is only a suspicion raised that the deceased was done to death by administering poison by the

The learned counsel for the petitioner further submits that the petitioner being the brother in law of the deceased is living separately from his brother and his sister in law and had no concern whatsoever with the family of his brother. It has further been stated that the father of the petitioner i.e. father in law of the deceased has been granted bail vide order dated 23.04.2024 passed in Cr. Misc. No. 80739 of 2023 which has been brought on record by way of Annexure-P3.
4. The learned APP for the State has opposed the prayer for bail and has stated that the petitioner along with his father had administered poison to the deceased and hence should not be granted the liberty of bail.
5. Considering the aforesaid submissions made by the parties and taking into account that there is no specific allegation against the petitioner and the co-accused namely, Dhanik Lal Sharma has already been granted bail by a Coordinate Bench of this Hon'ble Court as also taking into account that the petitioner is in custody since 30.11.2023, let the petitioner be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like
