JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 Petitioner prays for bail in connection with Phulpras P.S.Case No. 61 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 302, 504, 506 of the Indian Penal Code and 27 of the Arms Act.

Allegation against accused persons is of firing on the deceased, father of informant, due to which he died and petitioner is also named in the FIR.

Submission of learned counsel for the petitioner is that he is only member of mob and no specific allegation has been attributed against him and he is in custody since 12.7.2018. Further submission is that similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 29.10.2018 in Cr.Misc.No. 57029 of 2018. Heard learned APP also.

No.70066 of 2018(2) dt.05-12-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani, in connection with Phulpras P.S.Case No. 61 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
