2. The petitioner seeks regular bail in connection with S. Tr. No.450 of 2023 arising out of Nadi P.S. Case No.24 of 2021 lodged under Sections 302/34 of the IPC.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 08.11.2023 passed in Cr. Misc. No.58950 of 2023 with liberty to renew his prayer for bail after 9 months.

4. Learned counsel for the petitioner further submits that more than one year have crossed, but trial has not been concluded till date.

5. Learned counsel for the State opposes the prayer for bail and submits that progress report has been called for.

Patna High Court CR. MISC. No.80794 of 2024(3) dt.19-03-2025 2/2 From the report, it transpires that out of 7 witnesses, only one witness has been examined and for remaining witnesses, process has been issued and it is expected to be disposed within nine months.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner at present. Therefore, the bail application of the petitioner is hereby rejected.

7. However, it is hereby directed to the Superintendent of Police, Bhagalpur/Naugachia to do the needful so that the S.H.O. and I.O. shall provide all the witnesses to be examined within the specified period of time.

8. Registry is directed to communicate this order forthwith to the Superintendent of Police, Bhagalpur/Naugachia. Registry is further directed to hand over a copy of this order to learned A.P.P. who shall communicate this order to the Superintendent of Police, Bhagalpur/Naugachia at his level. (Dr. Anshuman, J.)
