The petitioner seeks bail in Muffasil P.S. Case No. 431/2018, instituted for offences under Sections 120B, 201 and 302/34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence father of informant had gone to see his poultry farm but did not return. On the next morning, the informant made search and found the dead body of his father lying in the campus of a newly constructed house situated at the eastern side of road leading to Mukundpur.
Learned counsel for the petitioner has submitted that F.I.R. is against unknown. Name of this petitioner has come on
Patna High Court Cr.Misc. No.70324 of 2018(2) dt.03-12-2018 2/2 the basis of statement of the spy given in para 19 of case diary. The police arrested this petitioner and recorded his confessional statement. Besides such materials, there is no allegation of specific overt act against this petitioner.
Petitioner is in custody since 24.07.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Vth, Samastipur in connection with Muffasil P.S. Case No. 431/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
