Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-05-2023 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 149, 341, 342, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

As per prosecution case, informant alleged that petitioner along with co-accused persons kidnapped him on pistol point. It is further alleged that when informant raised alarm, petitioner and co-accused persons assaulted on the head of the informant by means of garasa and iron rod due to which he sustained injury and became unconscious.

Patna High Court CR. MISC. No.6025 of 2023(2) dt.01-05-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to land dispute. From perusal of the FIR, it is alleged that the petitioner and co-accused Vikash Kumar Sanu assaulted by means of iron rod and gadasa, whereas injured sustained only one injury which is shown from injury report and the same has been annexed as Annexure-2. It is further submitted that coaccused persons have already been granted bail vide order dated 15.10.2022. The petitioner has remanded in this case from another case and languishing in judicial custody since 12.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Atri P.S. Case No. 191 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
