The petitioner apprehends his arrest in connection with Angarghat P.S. Case No. 70 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is recovery of 20 liters of country made Mahua liquor from the State High Way.. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.
In the facts and circumstances of the case, I am
Patna High Court CR. MISC. No.69621 of 2019(2) dt.21-11-2019 2/2 inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.10,000/- in the Patna High Court Legal Services Committee, Patna and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Samastipur in connection with Angarghat P.S. Case No. 70 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
