JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Balia (Begusarai) P.S. Case No. 316 of 2019 registered for the offences punishable under Sections 25(1-B) (a), 26 and 35 of the Arms Act.

As per FIR police on formation that petitioner and one co-accused have made firing and hiding in maize field went there and on seeing the police they fled away and on search of the house of petitioner and other co-accused one loaded country-made pistol along with live cartridges was recovered from the house of co-accused Bipin Kumar.

Submission of learned counsel for the petitioner is that though it is alleged that petitioner was also present but nothing has been recovered from his house and he has no criminal antecedent and he is ready to abide by any condition

In view of above facts and circumstances, let petitioner, in the event of surrender within a period of three weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Balia (Begusarai) P.S. Case No. 316 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation and appear before the police as soon as he is released on bail.
