JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Garkha P.S. Case No. 385 of 2018 instituted for the offence under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act.

Counsel for the petitioner submits that petitioner was not apprehended on the spot. Two persons were apprehended by police who disclosed their name as Sonu Kumar and Ajay. They disclosed before the police that petitioner and two other accused persons managed to run away.

Petitioner is in custody since 8.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
