The petitioner is in custody since 24.10.2018 in connection with Gobardhana P.S. Case No. 43 of 2018 for the offence registered under Sections 304, 120B and 506 Indian Penal Code.

Learned counsel for the petitioner submits that as per the first information report, it is apparent that death occurred on account of electric shock and, therefore, the allegation as made out against the petitioner is wholly false, frivolous and fabricated. It is further submitted that the story as made out that the petitioner had deliberately laid electric wire on the grill is mischievous and motivated as there was some dispute with regard to the registration of the land of the shop, in which, some money to the tune of Rs. 5 lakhs, exchanged hands.

No.76898 of 2018(2) dt.10-01-2019 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Gobardhana P.S. Case No. 43 of 2018.
