JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 307 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report but it would appear from perusal of the impugned order that the name of petitioner surfaced in course of investigation. However, learned counsel appearing for the petitioner submits that in course of investigation, the investigating officer at Para-10 and 11 of the case diary incorporated that some witnesses claimed that petitioner and some others had formed a Gang and the alleged occurrence might have committed by them and except the aforesaid

Patna High Court CR. MISC. No.69437 of 2019(2) dt.04-12-2019 2/2 material, there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-I cum Additional Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S. Case No. 575 of 2019.
