2. In the present case, the petitioner seeks bail in connection with Bodhgaya P.S. Case No. 425 of 2025, registered for the offences under Sections 115(2), 126(2), 117(2), 109, 303(2), 352, 351(2), 351(3), 3(5) of the BNS.
3. As per the prosecution case, the petitioner and other co-accused persons assaulted the informant and his brothers with pipe, sharp iron rod and garasa causing a number of injuries to him.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. There is counter version as co-accused Raushan Raj has filed Bodhgaya P.S. Case No. 424 of 2025 against the
Patna High Court CR. MISC. No.75211 of 2025(2) dt.24-11-2025 2/3 informant of the present case and his brothers alleging therein that after consuming liquor they came to the doors of the petitioner and assaulted the petitioner and his brother. Thereafter the instant case has been lodged. Similarly placed co-accused Raushan Raj has been granted bail by a Co-ordinate Bench of this Court vide order dated 11.08.2025 passed in Cr. Misc. No. 53720 of 2025. Learned counsel further submits that the injury report of the victims show simple injuries. The petitioner is having no criminal antecedent and he is in custody since 09.08.2025. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the case and its earlier counter version and simple nature of injuries of the victim and further considering the period of custody of the petitioner and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya/concerned court, in connection with Bodhgaya P.S. Case No. 425 of 2025, subject to the condition laid down under
Patna High Court CR. MISC. No.75211 of 2025(2) dt.24-11-2025 3/3 Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
